The Waterford Group has worked for hundreds and
hundreds of businesses nationwide and has been actively resolving debt issues for
clients since 1999. A trio of entrepreneur’s developed the concept and business
plan that became The Waterford Group, USA during the worst of circumstances.
One of the three was a Principal owner of a mid-sized firm that was struggling
under the strain of debt. This particular situation was caused as a result of
two (2) clients who failed to pay for services rendered as follows:
1.
Client A failed to
pay $1,700,000 for services rendered
2.
18 months later,
Client B failed to pay $1,900,000 for services rendered
At the time that Client A defaulted, the business was earning
approximately $7 million annually. We had increased to approximately $9 million
by the time client B defaulted, so the impact was disastrous. Creditors began a
series of actions including collections, foreclosures, and the filing of
lawsuits and liens. Dealing with this became a full time job. Our focus on the
business immediately began to disappear under the pressure and demands of the creditors. To
make matters worse, we had no asset protection measures in place for the
business.
During this tenuous time we began taking turns dealing with
the many creditors of the business. We all began to notice a similar pattern;
under the circumstances many of the creditors were willing to accept less than
what was owed to them and provide a release of any further liability in exchange for “cash now”.
We found this interesting and began to investigate further. We discovered that unsecured
creditors routinely lose more than 97% of what they are owed in a Chapter 11 or
Chapter 7 bankruptcy filing. Further, collecting a debt through the legal
system is a very expensive and frustrating process often also leading to the
collection of nothing.
With these facts in mind we began to focus on making
settlements with the creditors and thus honed our methods and techniques. We
routinely documented our results and setbacks and would meet together to discuss
them and any new ideas. Thus began the development of our resolution process
which now bears unequalled results for our clients.
Locally, word began to spread about
our dynamic new service
and eventually a former acquaintance in business contacted us for help. Due
to mismanagement, a once strong firm was now failing financially. Through
our intervention, our client was able to work his way out of debt, pay his
creditors and save his business over a period of 15 months. In addition we immediately
ended his (and that of his creditors) need to spend money on attorney fees,
court costs and possible bankruptcy filing fees. Due to this success, we
decided to actively market our service to the small to medium sized business community
nationwide. We have been
successfully settling debt and helping turn clients businesses around ever
since.
